YES, YOU DEFINITELY ARE!! In Cali you can lose your britches with legal fees for just about anything. Especially if they are not all fixed, your neighbor can take you to court and sue you for $$ damages. Find a group like Alley Cat Allies and get suggestions about moving a colony, or in getting help with taking care of the colony... ^_^
