Sorry it's been so long but I was waiting for more info before I posted something. Looks like the neighbors divorce case is set back to May since the April docket is full so I'm going to have to file and just see if time is on our side since the wife will not testify on my behalf until after her divorce hearing. Turns out the man lied to get the permits for his guns and to join gun club and did NOT disclose his PTSD. He is also supposedly disabled and gets $3000/month from disability but is working at the prison anyway bringing in another $2550/month so the wife is going to notify his disability and job to make sure they know what is going on. It's not going to look good for him when they realize what he's doing with disability and working as a prison guard with all his issues. More and more info is coming out in the open that can help our case. If they had checked him out further, he would not have had guns on his property. Thus, this would not have happened to Saxony. Thanks for all the support and advice that all of you have offered up. I will keep everyone posted on progress but it has been slow. Seems like everytime we think something is going our way, we have a setback. We also cannot find really anyone to take our case as there are only a small (and not very good) circle of people that work cases in this area and for the price that they are going to charge, I'm not sure it will be worth it. Also, we are having a little difficulty from what we've been told, we will have to prove what future income we lost, not necessarily the money we put into her. One lawyers secretary said that in cases like this it is hard to determine "worth" because you can only get the replacement value of the dog, and cannot be reimbursed for money or time put into the dog that made her worth more. I could only be reimbursed for the price of another puppy of comparable value. Also, I don't know if we can get income we lost, because we retired her last year and were only briefly considering a litter to hold back some future prospects, but with time against us due to her age, we pretty much decided it wasn't going to happen. Also, there is no way to determine the number in the litter, and the value of what the pups would go for. As you all know, price of dogs vary considerably depending on who you get them from. Unfortunately, her lines are not out there anymore and she was a pup out of the last litter with her parents so there is no way to even find a "comparable" pup. These were older lines from Kachina and Bravestar and neither of these kennels are breeding anymore and pups with either Kachina or Bravestar in their background are several generations out and pretty washed out now. So, I have a lot of paperwork to gather up and see what I can do. Basically criminal charges are out the window and no one around here would even push the issue with charging him, so basically I'm left with only a civil suit which is not looking good as far as lost money and/or compensation. We're going to try and do what we can and I'll keep everyone posted and so far so good as the wife is willing to stick it to him pretty good and obviously she has much more information on the incident, and him. I'll post more as I find out more!

Unfortunately legally pets are still classified as "property" rather than family members so pain and suffering payments are out, according to what I've read... if someone is responsible for the death of your pet and you win a suit against them, all they can be held responsible for is the monetary "value" of the pet. frown

Logan County Oklahoma - Pet owners abandon their dogs constantly at Liberty Lake. Some end up roaming wild in packs and will scavenge for food, even if it means trying to bring down a calf.
Rodney Anderson and Kevin Bowan enjoy their hunting hounds. They take the unleashed animals out for routine exercise on a regular basis. On this occasion they took five well bred hunting dogs of high value to Liberty Lake for a run. Upon their release from the dog boxes, it was then the slaughter began. Rodney Luckenbill had his shotgun and decided to shoot the hunting dogs.


Most likely Luckenbill anticipated another pack of dogs were after his cattle that graze adjacent to the public land. Rather than letting animal control deal with the dogs, Luckenbill admits to dealing with the situation himself. Luckenbill has stated publicly he killed the hounds on public land. Luckenbill violated Oklahoma State Statues.
Anderson and Bowan immediately went to the sound of the rounds being discharged. On their arrival, they saw their animals had been slaughtered. Luckenbill stood defiantly over the dead carcasses. The dog owners approached Luckenbill that day with much restraint. After a verbal confrontation, Luckenbill pointed his loaded weapon and threatened to shoot Bowan. Local authorities arrived and Officer Hamilton of the Guthrie Police Department was informed by all parties involved of events that had taken place. Officer Hamilton was informed by Bowen that Luckenbill had pointed a loaded weapon at him and threatened to shoot him. Anticipating an immediate arrest, the hound owners were shunned. At the time of this writing, no charges have been filed against Luckenbill.
The Facts...
1. Hunting Hounds don't chase cattle.
2. Rodney Anderson and Kevin Bowan took their valuable sport animals to Liberty Lake for exercise on public property in Logan County Oklahoma on April 22nd, 2008 at approximately 5pm.
3. Rodney Luckenbill shot multiple rounds and killed the animals on public property.
4. The Oklahoma Humane Society (Cynthia Armstrong) has reviewed the case and dictates felony animal cruelty charges should be filed against Luckenbill.
5. Rodney Luckenbill admittedly transported a loaded firearm in his personal vehicle in the public domain.
6. Rodney Luckenbill possessed a loaded firearm during the commission of a felony.
7. Rodney Luckenbill discharged a weapon in the public domain.
8. Rodney Luckenbill pointed a loaded firearm at another person.

The District Attorney's Office of Logan County has been made aware of the violations of the Oklahoma State Statues.
Liberty Lake is situated in Logan County. It is located between Broadway and Coltrane Road, approximately eight miles south of the City of Guthrie, Oklahoma and ten miles north of Edmond, Oklahoma. It consists of 167 acres with five miles of shoreline.
Liberty Lake is in the public domain. Amenities include a boat ramp; boat dock; campsites; camper parking with electricity; picnic areas with grills and trash bins; restrooms and drinking water.
Robert 'Rob' L. Hudson is the current District Attorney for Logan and Payne county. If you wish to telephone the DA's office to make an inquire as to why no prosecution is being made, ask to speak to a DA's investigator... Hudson most likely will not be available.

GUTHRIE, Okla. - Two Logan County men want animal cruelty charges filed against the man who shot their five hunting dogs.
Rodney Luckenbill said he shot the dogs because they were attacking his cattle, but the two men who raised and trained the hounds say they don't believe him.
'Hounds don't chase cattle,' said Rodney Anderson, the dogs' owner. 'These dogs have been around hundred of cows and haven't touched a cow in their life.'
Anderson and his partner, Kevin Bowan, said they often bring their horses and hounds to Liberty Lake for exercise. They said they don't use a leash because it's never been a problem.
Luckenbill lives near the public property. He said two of the dogs attacked his cattle on private property.
He then chased the dogs off the property and fired his gun after they tried to attack him, he said.
Cynthia Armstrong, Oklahoma director for the Humane Society of the United States, said her office receives several calls about dog shootings around the state.
While a leash could have prevented this tragedy, Armstrong said she thinks the gunman had no right to shoot.
'Even though we do have a statute that permits the shooting of dogs that are found chasing livestock, that statute doesn't contemplate pursing dogs to public land and conducting wholesale slaughter of those dogs,' Armstrong said.
She said the Humane Society would like to see felony animal cruelty charges filed against Luckenbill. The Guthrie Police Department said it's still investigating this case.
Luckenbill said he was considering his own legal actions for the injuries and damage done to his cattle by the dogs.
