A Cape Breton woman is spearheading a class-action lawsuit against the makers of pet foods that allegedly caused sometimes-fatal or potentially fatal kidney failure in a number of dogs and cats.Halifax lawyer Raymond Wagner filed a statement of claim against Menu Foods Inc. on Wednesday on behalf of Jackie Doucette of Ingonish Beach and "a class of other individuals resident in Nova Scotia who purchased dog or cat food manufactured by the defendants between December 3, 2006 and March 6."Menu Foods, based in Streetsville, Ont., announced a recall of more than 60 million pet food items on March 16, following reports of dogs and cats becoming ill and dying after eating the company’s food.In most cases, the animals became unusually lethargic, refused food and lost weight.Ms. Doucette is claiming that her four-year-old dog Sissy first became ill in February after being fed Ol’ Roy and President’s Choice dog food. In March, Ms. Doucette took Sissy to a veterinarian, who told her the dog had suffered blood loss and may have ingested poison. Sissy was placed on intravenous medication by the vet for five days and received a blood transfusion, which improved her health.In April, however, Sissy again became ill and returned to the veterinarian. Several tests and procedures were performed to determine what the problem was and Sissy was eventually prescribed drugs."It was the vet, after the second time around, who basically suggested that it was probably due to the food," Ms. Doucette’s son, Bob, said in a telephone interview Thursday. "Through all this, my mom was out of pocket quite a bit of money, maybe $1,200 to $1,500 in vet bills, let alone time and expense."Mr. Doucette said he and his mother answered an advertisement posted by Mr. Wagner in a newspaper calling for people who had experienced problems with some of the recalled pet foods to share their stories.In the claim, which Mr. Wagner said is still in the certification stage, Ms. Doucette and other plaintiffs are saying the company was negligent in the "manufacturing, marketing, promotion, selling, and distribution of (Menu Foods) pet foods in complete disregard for the health and safety" of their pets. They also claim the company had a responsibility to ensure any pet foods it manufactured used ingredients that were proven safe for consumption by dogs and cats and that once the company became aware of the presence of contaminants in the foods that could be harmful to animals, it should have warned customers.Ms. Doucette and any others involved in the lawsuit are asking for damages for the "pain and suffering" they experienced from having to watch their pets’ health deteriorate as well as for costs associated with veterinarian bills or medications.Pet owners across Canada united to follow the class-action route to compensation following the recall.According to a statement by Menu Foods president and CEO Paul K. Henderson at the company’s annual general meeting on June 29, there are more than 100 class-action lawsuits filed against the company in Canada and the U.S. Mr. Henderson told the meeting that the suspected contaminant in the tainted foods, a mildly toxic chemical commonly added to animal feed in China, has since been removed from the company’s products.Mr. Henderson also noted that the company is working towards a fair settlement for anyone affected by the tainted products.( peverest@herald.ca) Back
